Terms of Service

Braindump is a personal note-taking application that offers:

• A local-first writing environment
• Optional syncing across devices
• Smart recommendations generated on your device
• Contextual features (e.g., location-based suggestions, if enabled)

Braindump is currently in early access, meaning features may change, break, or evolve rapidly.

You must be at least 16 years old to use the Service.

By using Braindump, you confirm that:

• You can legally enter into agreements
• You are using the Service for personal, lawful purposes
• You will comply with these Terms

To use Braindump, you must create an account using Firebase Authentication.

You are responsible for:

• Maintaining the security of your account
• Keeping your login credentials private
• Any activity that occurs under your account

If you suspect unauthorized access, please contact us immediately.

You own the notes and content you create in Braindump.

By using the Service, you give us a limited, revocable license to store and process your content only as needed to provide the Service (e.g., syncing, backups, recommendations, indexing).

We never use your content:

• To train machine learning models
• For advertising
• For resale

You can delete your content at any time from inside the app.

Local-First

Most recommendation, embedding, and search functions run on your device.

Optional Sync

If you choose to enable syncing:

• Your notes and settings will be stored securely in Firebase
• Data is encrypted in transit and at rest, but not end-to-end encrypted
• You are responsible for backing up your data if sync is disabled
• We cannot restore data that existed only locally and was never synced.

If you enable location access, we may use your device's approximate location to:

• Improve note recommendations
• Provide contextual features

You can disable location access at any time.

Syncing and certain features may require a paid plan processed by Polar.

By subscribing, you agree that:

• Charges will recur automatically until you cancel
• You are responsible for managing your subscription through Polar
• Fees are non-refundable, except at our sole discretion
• Pricing may change, and you will be notified before changes apply
• If payment fails, we may pause your syncing and access to paid features.

You agree not to:

• Attempt to reverse-engineer, copy, or reproduce the Service
• Damage or overload the infrastructure
• Use Braindump for unlawful purposes
• Attempt unauthorized access to data or systems
• Share harmful, malicious, or manipulative content
• Bypass security measures
• Use automated scraping tools

We may suspend accounts that violate these rules.

Because Braindump is in early access:

• Features may change without notice
• Bugs may occur
• Data issues may occur (although rare)
• We may temporarily remove or modify features
• We may restrict access to maintain stability

To avoid data loss, enable syncing and remain online during important sessions.

The Service is provided "as is" and "as available", without warranties of any kind.

We do not guarantee:

• That the Service will be error-free
• That syncing or storage will always be available
• That recommendations will be accurate
• That data loss will never occur

You use the Service at your own risk.

To the maximum extent permitted by law, our liability to you is limited to:

• the amount you paid to us in the previous 12 months,
• or $50 CAD
• whichever is lower.

We are not responsible for:

• Indirect, incidental, or consequential damages
• Loss of data resulting from local device issues
• Data that was never synced
• Third-party failures (e.g., Firebase or Vercel outages)

Before formal action, both parties agree to attempt informal resolution for 30 days.

If unresolved, disputes will be settled through binding arbitration in:

• Hamilton, Ontario, Canada,
• in English,
• with one arbitrator.

You agree not to bring class actions against us.

We may update these Terms from time to time. Significant changes will be announced through the app or email.

Your continued use of the Service after changes indicates acceptance.
